These Terms of Service govern your use of TheCollectibleCard.com and purchases made through our website. In these terms, “we,” “us,” and “our” refer to TheCollectibleCard.com.

Shopify provides our ecommerce platform, which enables us to offer our products and services to you.

Our Refund and Return Policy, Shipping Policy, and Privacy Policy provide additional information about your purchases and use of our website.

Nothing in these Terms of Service limits any mandatory consumer rights or remedies that cannot lawfully be excluded or restricted under applicable law.

1. Using the Store

By using our website or placing an order, you confirm that you have the legal capacity to enter into a binding agreement or have the authorization of a parent or legal guardian where required by law.

You agree to provide accurate, current, and complete contact, billing, and shipping information when placing an order. You must use a payment method that you are legally authorized to use and keep your account credentials secure.

You are responsible for ensuring that the information provided with your order is accurate. We are not responsible for delivery issues caused by incorrect information you provide, except where applicable law requires otherwise.

2. Product Descriptions and Condition

Please review the selected product, variant, quantity, language, edition, packaging, and condition carefully before completing your purchase.

Product descriptions, listing details, and specific commitments made as part of an offer form part of your purchase. Product photographs and screen colors may vary from the actual appearance of an item. Such differences do not excuse the delivery of an incorrect product or an item whose condition is materially inconsistent with its listing.

Raw Cards: Raw, ungraded cards are not guaranteed to receive any particular grade from a grading company. Their condition may vary, and any condition descriptions provided in the listing should be reviewed before purchase.

Graded Cards: Graded cards are identified by the grading company and grade stated in the listing. Please review the specific card, grading company, grade, and any other listing details before ordering.

Sealed and Randomized Products: Randomized products, mystery products, and sealed products do not guarantee a particular card, character, rarity, pull, or resale value unless the relevant product listing expressly states otherwise. Any odds, contents, exclusions, or promotional conditions specifically disclosed in a listing apply to that offer.

Product descriptions and images are intended to identify the item being sold. We do not guarantee future market value, appreciation, resale price, or grading outcomes.

3. Prices, Checkout, and Payment

The checkout page and order summary identify the price, currency, applicable taxes, shipping charges, and other fees collected with your order.

Your bank or payment provider may charge additional currency conversion, international transaction, or other service fees. Such fees are determined by your provider and are not controlled by us.

Import duties, tariffs, and taxes are handled according to the information displayed at checkout and the terms described in our Shipping Policy. Where such charges are not collected or prepaid at checkout, you may be responsible for applicable charges imposed by customs or other authorities, subject to applicable law.

Market Pricing and Product Differences

Collectible card markets can change quickly. We may update product prices to reflect market conditions, availability, demand, and other relevant factors. A product may therefore have a different price from one day to the next.

Prices may vary depending on the exact product, variant, language, edition, card condition, sealed packaging condition, grading company, and grade. Items that appear similar may not be equivalent in market value or condition.

The price agreed upon for a completed purchase will not be adjusted solely because the market price subsequently increases or decreases. A later price reduction, market decline, or promotional offer does not by itself entitle you to a refund, store credit, or price adjustment.

Likewise, we will not automatically charge you more for a completed order because the market price subsequently increases.

These terms do not affect your rights or remedies for an incorrect product, a material listing error, a defective or misdescribed item, or any other circumstance where applicable law provides a remedy. We do not guarantee future resale value or investment returns.

Actual Listing or Price-Entry Errors

An actual listing or price-entry error, such as an incorrect price entered when creating or updating a product listing, is different from ordinary market fluctuations or a price that has become outdated.

We may correct inaccurate listings for future purchases. If an error affects an existing order, we will contact you, explain the issue, and review the available lawful options.

Where appropriate and permitted by applicable law, an affected order may be canceled and refunded. We will not automatically charge you a corrected or higher price. Any replacement purchase or additional payment requires your express agreement.

Nothing in this section overrides applicable contract law or mandatory consumer protections.

4. Inventory, Verification, and Preorders

Inventory Availability

Product availability may change, and inventory discrepancies may occasionally occur. If we cannot supply an item as ordered, we will contact you and explain the available options, which may include an agreed replacement, a reasonable waiting arrangement, or a refund for the unavailable item.

Any replacement that changes the product or price requires your agreement. We will not automatically substitute a different item without your consent, except where permitted by applicable law.

Payment and Identity Verification

We may request reasonable payment or identity verification when necessary to prevent fraud, verify a transaction, or protect the security of an order.

If an order requires verification, fulfillment may be held while the verification process is completed. Please contact us if you cannot complete the requested process so that we can review the available options for your order.

We will not represent a verification as approved, an order as shipped, or a refund as processed until the relevant action has been confirmed.

Preorders

If a product is offered for preorder, the product listing will provide any available expected release or shipping information.

Preorder dates and estimates may change due to supplier delays, release schedules, or other circumstances outside our control. If availability changes materially, we will provide an update and review the options available under our stated policies and applicable law.

Nothing in this section removes any cancellation or refund rights that apply to your order.

5. Shipping, Cancellations, and Remedies

Our Shipping Policy explains our order processing, delivery estimates, tracking information, and procedures for shipping issues.

If you wish to cancel or change an order, please contact us as soon as possible before fulfillment. We cannot guarantee that a cancellation or change can be accommodated once an order has entered fulfillment or has been shipped.

Any restrictions on returns for change of mind are subject to our Refund and Return Policy and applicable law. Such restrictions do not remove rights or remedies that may apply to incorrect, missing, damaged, defective, or materially misdescribed products, non-delivery, or other legally protected circumstances.

Where a store credit or replacement is offered instead of a monetary refund, your agreement will be obtained where required by applicable law.

If you purchased optional shipping protection, the applicable terms and any available claim process will be governed by the information disclosed for that protection at the time of purchase. Optional shipping protection does not replace or limit any rights you have under applicable law.

6. Promotions, Gifts, and Mystery Products

Promotional offers, gifts, mystery products, and special releases are subject to the eligibility requirements, product details, dates, odds, contents, and restrictions disclosed in the relevant offer.

For randomized products, please review the product listing for any disclosed pull odds, chase items, exclusions, or other details explaining how the product works.

If a product variant is identified as imperfect, discounted, or otherwise subject to a specific condition description, review that information before purchase.

If a promotional item is missing or an offer has not been fulfilled as described, please contact us with your order number and relevant details so we can investigate.

Images, videos, examples, or promotional materials do not replace the specific terms disclosed for the offer you purchase. Changes to future promotions do not retroactively remove commitments that applied to a completed order.

Please include your order number and a description of the issue. We may request reasonable supporting information, such as photographs or shipping details, to investigate and resolve your concern.

We will review customer inquiries and communicate available next steps. A shipping carrier investigation or internal support review does not prevent you from exercising any applicable consumer rights.

8. Acceptable Use and Website Content

You agree not to use our website or services for fraud, unauthorized payment activity, unlawful transactions, infringement of intellectual property rights, harassment, distribution of malicious software, interference with website operations, or attempts to bypass security measures.

We may take reasonable action to restrict misuse of our website, subject to applicable law.

Unless otherwise stated, website text, branding, graphics, photographs, and other content are owned by us or used with permission from their respective owners. You may not reproduce, distribute, or commercially use protected content without appropriate authorization, except where permitted by law.

If you submit a review, photograph, or other content, you confirm that you have the necessary rights to submit it. We may use submitted reviews or other content to display, moderate, and manage customer feedback, subject to applicable law and our Privacy Policy.

Sending a private customer support message does not grant us permission to publicly display your personal information.

9. Third-Party Services and Liability

Our website may contain links to third-party websites or use third-party services. Those services may be governed by their own terms and privacy policies.

The presence of a third-party service or link does not remove our responsibilities for the products or services we sell.

We do not guarantee that our website will always be available, uninterrupted, or error-free. We also do not guarantee that collectible card prices will increase or that any product will achieve a particular resale value or grading result.

To the maximum extent permitted by applicable law, we are not responsible for losses arising solely from market price fluctuations, changes in collectible demand, or speculative expectations about future resale value.

Nothing in these Terms of Service excludes or limits any liability, legal guarantee, consumer right, or remedy that cannot lawfully be excluded or limited. Any permitted limitation applies only to the extent allowed by applicable law.

10. Governing Law and Changes

These Terms of Service are governed by the laws of the State of Delaware, United States, and applicable federal law, without regard to conflict-of-law principles, except where the mandatory laws of another jurisdiction apply.

Nothing in these Terms of Service excludes or limits any mandatory consumer rights or remedies available under applicable law. Nothing in these terms requires a consumer to waive legal protections or submit a claim to a court or jurisdiction where such a requirement is prohibited by law.

The version of these Terms of Service in effect when you place an order will generally apply to that purchase, subject to applicable law. We may update these terms for future transactions by publishing a revised version on our website and updating the “Last updated” date.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
